Transport Management Software - Privacy Policy

1. Scope of Service
1.1. These Terms & Conditions govern the use of our Transport Management Software ("TMS"), which provides fleet tracking, booking, seat booking engine, driver management, invoicing, and other transport-related functionalities.
1.2. By accessing or using the TMS, you confirm that you have read, understood, and agreed to these Terms & Conditions and our Privacy Policy.
1.3. The software may be updated periodically, and continued use after such updates constitutes acceptance of the revised terms.

2. User Accounts & Responsibilities
2.1. Users must provide accurate and complete information during registration and maintain the confidentiality of their login credentials.
2.2. Users are responsible for all activity occurring under their account and must immediately notify the provider of any unauthorized use.
2.3. Multiple registrations for the same user are prohibited.

3. Services & Contracts
3.1. The TMS facilitates transport management services and operates as a transport company.
3.2. Contracts for transport services are directly between users and third-party service providers. The provider is not liable for any service failures, delays, or damages resulting from third-party engagements.
3.3. Users must comply with all applicable transport laws and regulations when using the software.

4. Payment & Subscription
4.1. The TMS operates on a freemium model, with both free and premium subscription plans.
4.2. Payments for premium plans must be made in accordance with the agreed terms. Failure to pay may result in service suspension.
4.3. Subscription fees are non-refundable unless otherwise stated.

5. Privacy & Data Protection
5.1. The provider collects and processes personal data per the Privacy Policy.
5.2. User data is stored securely, and necessary measures are taken to prevent unauthorized access.
5.3. Users agree that anonymized data may be used for analytics and service improvement.

6. User Obligations
6.1. Users must not use the TMS for illegal or fraudulent activities.
6.2. Users shall not upload harmful content, including viruses, malware, or any material that infringes on third-party rights.
6.3. Unauthorized access, data scraping, or attempting to breach security is strictly prohibited.

7. Termination & Suspension
7.1. The provider reserves the right to suspend or terminate any user account in case of breach of these Terms & Conditions.
7.2. Users may delete their accounts at any time, subject to applicable data retention policies.

8. Liability & Disclaimers
8.1. The provider does not guarantee uninterrupted service and is not liable for technical failures beyond its control.
8.2. The TMS is provided "as is," without warranties of any kind, express or implied.
8.3. The provider is not responsible for any loss, damages, or disputes arising from the use of third-party services integrated into the TMS.

9. Location & Distance Tracking
9.1. Our software uses real-time GPS and location services to calculate travel distance and duration for rent-a-car and driver-based services.
9.2. Location data is used strictly to determine ride charges based on distance and travel time.
9.3. The app requests location permission from users and does not share personal location data with unauthorized third parties.
9.4. Users can manage their location permission settings via their device settings. Disabling location may affect certain functionalities of the app.
9.5. All location data is processed in compliance with our Privacy Policy and relevant data protection laws.

10. Changes to Terms & Conditions
10.1. The provider may update these Terms & Conditions at any time. Continued use of the software after changes constitutes acceptance of the revised terms.

11. Governing Law & Jurisdiction
11.1. These Terms & Conditions are governed by the laws of the People's Republic of Bangladesh.
11.2. Any disputes shall be resolved in the appropriate courts within Bangladesh.
